Restrictions on acceptance of applications7.

(1)

The Minister shall not accept an application from an applicant who occupies his holding as a tenant unless the applicant has satisfied the Minister that he has notified his landlord in writing of the making of such application.

(2)

The Minister may refuse to accept an application where the Minister is satisfied that—

(a)

the use of any land in accordance with the proposals contained in that application would frustrate the purposes of any assistance previously given or to be given out of money provided by Parliament or by the European Community;

(b)

payment of aid under these Regulations in respect of any land on which an applicant proposes to carry on organic farming would duplicate any assistance previously given or to be given out of money provided by Parliament or by the European Community.
