HUMAN FERTILISATION AND EMBRYOLOGY

The Human Fertilisation and Embryology Act 1990 (Commencement No. 5) Order 1994

The Secretary of State for Health, in exercise of powers conferred by section 49(2) of the Human Fertilisation and Embryology Act 1990(1)and of all other powers enabling her in that behalf, hereby makes the following Order:

Citation and interpretation

1.—(1) This Order may be cited as the Human Fertilisation and Embryology Act 1990 (Commencement No. 5) Order 1994.

(2) In this Order “the Act” means the Human Fertilisation and Embryology Act 1990.

Appointed days

2.—(1) 5th July 1994 is the day appointed for the coming into force of subsections (9) and (10) of section 30 of the Act (parental orders in favour of gamete donors) and of section 48(1) of the Act (extent) so far as it relates to those subsections.

(2) 1st November 1994 is the day appointed for the coming into force of the remaining provisions of section 30 of the Act (parental orders in favour of gamete donors) and section 48(1) of the Act (extent) so far as it relates to those provisions.

Explanatory Note

(This note is not part of the Order)

This Order brings sections 30(9) and (10) and 48(1), so far as it relates to that subsection, of the Human Fertilisation and Embryology Act 1990 into force on 5th July 1994 and the remaining provisions of section 30 and 48(1) so far as it relates to those provisions, into force on 1st November 1994. All of the provisions brought into force by this Order concern parental orders for gamete donors. In bringing them into force, this Order brings into force all those provisions of the Human Fertilisation and Embryology Act 1990 which are not already in force.
