CONTAMINATION OF FOOD

The Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) Orders 1994 Revocation Order 1994

Coming into force in accordance with article 1

The Secretary of State, in exercise of the powers conferred on him by section 1(1) and (2) and section 24(1) of the Food and Environment Protection Act 1985(1), and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement

1.  This Order may be cited as the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) Orders 1994 Revocation Order 1994 and shall come into force at 18.00 hours on 19th August 1994.

Revocation

2.  The following Orders are hereby revoked:—

(a)the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) Order 1994(2); and

(b)the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) (No.3) Order 1994(3).

Explanatory Note

(This note is not part of the Order)

This Order revokes the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) Order 1994 (“the No.1 Order”) and the Food Protection (Emergency Prohibitions) (Paralytic Shellfish Poisoning) (No.3) Order 1994 (“the No.3 Order”) which prohibited—

(a)fishing for or taking (in the case of the No.1 Order) mussels, scallops and razor clams and (in the case of the No.3 Order) cockles, mussels, scallops and razor clams as defined (article 1), within the areas designated in the Schedule respective to each Order (article 4);

(b)movement of such shellfish out of those areas (article 5); and

(c)landing, using in the preparation or processing for supply of food of, supplying and other specified activities in relation to, such shellfish from the designated areas within the United Kingdom (article 6).

The effect of this Order is to remove completely the prohibition from fishing for, taking, moving, landing, using in food production and supplying the shellfish affected by the Orders from the areas designated in the Schedule respective to each Order.
