The Secretary of State for Health, in exercise of the powers conferred on her by section 92(1) of the National Health Service Act 1977(1) and of all other powers enabling her in that behalf, having regard to the change in the arrangements for the administration of facilities formerly managed by the Plymouth Health Authority resulting from a change in the functions of that Health Authority and the South Western Regional Health Authority, having consulted that Regional Health Authority and the Plymouth and Torbay Health Authority(2) in accordance with section 92(3) of that Act, hereby makes the following Order:

Citation, commencement and interpretation

1.—(1) This Order may be cited as the South Western Regional Health Authority (Transfer of Trust Property); Order 1994 and shall come into force on 3rd March 1994.

(2) In this Order “the trust property” means the items specified in a schedule of trust property prepared by and agreed upon by the Plymouth and Torbay Health Authority and the South Western Regional Health Authority on 20th October 1993, which schedule has been signed on behalf of both those Authorities.

Transfer of trust property

2.  On 3rd March 1994 the trust property shall be transferred from the Plymouth and Torbay Health Authority to the South Western Regional Health Authority.

Explanatory Note

(This note is not part of the Order)

This Order transfers to the South Western Regional Health Authority on 3rd February 1994 trust property formerly held by the Plymouth and Torbay Health Authority, in consequence of the transfer from the latter to the former of the function of managing the Tor and South West College of Health. A copy of the schedule of trust property to which the Order refers can be obtained at the Department of Health, National Health Service Trust Unit, Quarry House, Quarry Hill, Leeds LS2 7UE.
