PART VIMEETINGS OF REGISTERED PRODUCERS

Annual General Meetings

26.  Section 40 of the marketing scheme is preserved, subject to the modification that–

(a)for the words “once at least every calendar year, and not more than fifteen months after the holding of the last preceding General Meeting,” there shall be substituted the words “as they think fit in each calendar year starting with 1995”;

(b)in paragraph (a)–

(i)for the word “submitting” there shall be substituted the word “noting”; and

(ii)the words “to registered producers” shall be omitted; and

(c)paragraphs (b) and (c) shall be omitted.

Notice of General Meetings

27.  Section 41 of the marketing scheme is preserved.

Special General Meetings

28.  Section 42 of the marketing scheme is preserved, subject to the modification that for the word “twenty-five” there shall be substituted the word “ten”.

Voting at General Meetings

29.  Section 43 of and Schedule (4) to the marketing scheme are preserved, subject to the modification that–

(a)in subsection (2) for the words “cow registered with the Board at the time of the poll” there shall be substituted “10,000 litres of milk produced and sold by him to the Board or on which contributions were paid during the period of 12 months ending immediately before Vesting Day.”, the words “as being in his possession, and” shall be omitted and for the word “votes” there shall be substituted the word “Votes”;

(b)in subsection (6) for the words “Schedule (4)” there shall be substituted the words “Schedule (1)”; and

(c)in Schedule (4) for the figure “(4)” there shall be substituted the figure “(1)” and for the words “Scheme 1984” there shall be substituted the words “Board (Residual Functions) Regulations 1994”.

Quorum at General Meetings

30.  Section 44 of the marketing scheme is preserved, subject to the modification that for the words “twenty-five” there shall be substituted the word “five”, and the words from “except where” to the end shall be omitted.
