The Bovine Offal (Prohibition) (Amendment) Regulations 1994

The Minister of Agriculture, Fisheries and Food, the Secretary of State for Health and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred by section 16(1)(a) and (f) and (3) of, and paragraph 3(1) of Schedule 1 to, the Food Safety Act 1990(1) and of all other powers enabling them in that behalf, hereby make the following Regulations after consultation in accordance with section 48 of the said Act with such organisations as appear to them to be representative of interests likely to be substantially affected by the Regulations:

Title, commencement and interpretation

1.—(1) These Regulations may be cited as the Bovine Offal (Prohibition) (Amendment) Regulations 1994 and shall come into force on 2nd November 1994.

(2) In these Regulations “the principal Regulations” means the Bovine Offal (Prohibition) Regulations 1989(2).

Amendment of the principal Regulations

2.  The principal Regulations shall be amended in accordance with the following provisions of these Regulations.

3.  In regulation 2(1) of the principal Regulations—

(a)after the definition of “excepted premises” there shall be inserted the following definition:—

“excluded matter” in relation to any bovine animal which has died or been slaughtered in the United Kingdom means any part of such an animal which does not consist of or contain any specified bovine offal;;

(b)for the definition of “specified bovine offal” there shall be substituted the following:—

“specified bovine offal” means the following parts of a bovine animal—

(a)the brain, spinal cord, spleen, thymus, tonsils and intestines of an animal, more than six months of age, which has died or been slaughtered in the United Kingdom;

(b)the thymus and intestines of an animal, two months or over but not more than six months of age, which has died or been slaughtered in the United Kingdom;

(c)the thymus and intestines of an animal, under two months of age, which has been slaughtered in the United Kingdom; and

which no longer form part of the carcase of an animal..

4.  Paragraph (1) of regulation 3 of the principal Regulations shall be deleted.

5.  In regulation 7 of the principal Regulations the following shall be deleted:—

(a)paragraph (1)(e) and the word “or” immediately preceding it; and

(b)paragraph (2).

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Bovine Offal (Prohibition) Regulations 1989 (S.I. 1989/2061) (the “principal Regulations”).

The controls under the principal Regulations applied to the brain, spinal cord, spleen, thymus, tonsils and intestines of any bovine animal slaughtered in the United Kingdom and which was over six months old at the time of such slaughter.

The Regulations amend the principal Regulations so as to extend the controls on specified bovine offal (defined in the Regulations) to include the thymus and intestines of all bovine animals, except those of animals under two months of age which have died (rather than have been slaughtered) (regulations 3(b) and 4).

The opportunity has been taken to delete references to the Slaughterhouses (Hygiene) Regulations 1977 (S.I. 1977/1805) which were revoked by the Fresh Meat (Hygiene and Inspection) Regulations 1992 (S.I. 1992/2037) (regulation 5).

A Compliance Cost Assessment in relation to these Regulations has been placed in the libraries of both Houses of Parliament and copies can be obtained from the Meat Hygiene Division of the Ministry of Agriculture, Fisheries and Food, Government Buildings, Hook Rise South, Tolworth, Surbiton, Surrey KT6 7NF.
