ROAD TRAFFIC

The Road Traffic (Special Parking Areas) (London Borough of Barnet) (Amendment) Order 1994

Whereas the council of the London borough of Barnet has applied to the Secretary of State for an order to be made under section 76 of the Road Traffic Act 1991(1) and the Secretary of State has consulted the Commissioner of Police of the Metropolis in accordance with section 76(2) of that Act:

NOW, the Secretary of State for Transport, in exercise of the powers conferred by section 76(1) and section 77(6) of the Road Traffic Act 1991 and of all other powers enabling him in that behalf, hereby makes the following Order:—

Citation and commencement

1.  This Order may be cited as the Road Traffic (Special Parking Areas) (London Borough of Barnet) (Amendment) Order 1994 and shall come into force on 28th November 1994.

Interpretation

2.  In this Order “the principal order” means the Road Traffic (Special Parking Areas) (London Borough of Barnet) Order 1994(2).

Amendment of the principal order

3.—(1) The principal order shall be amended as follows.

(2) In article 2(1)—

(a)for the third unnumbered sub-paragraph there shall be substituted:

a reference to the Schedule is a reference to the Schedule to this Order;;

(b)for the words “Schedule 4” where they occur in the fourth and fifth unnumbered sub-paragraphs there shall in each case be substituted “the Schedule”; and

(c)for the words “that Schedule” in the fifth unnumbered sub-paragraph there shall be substituted “the Schedule”.

(3) Paragraphs (2) and (3) of article 2 shall be omitted.

(4) For article 3 there shall be substituted:

3.(1) The Secretary of State hereby designates the London borough of Barnet except the roads named or described in the Schedule as a special parking area.

(2) A reference in the following provisions of this Order to the special parking area is a reference to the area designated by this article.

(5) For the words “an area” in article 4(1)(b), there shall be substituted “the area”.

(6) For the words “a special parking area” in article 4(2) and article 5(1), article 5(2) (in the place where those words first occur) and article 5(4) and (5) there shall in each case be substituted “the special parking area”.

(7) For Schedules 1, 2, 3 and 4, there shall be substituted the Schedule contained in the Schedule to this Order.

Explanatory Note

(This note is not part of the Order)

This Order amends the Road Traffic (Special Parking Areas) (London Borough of Barnet) Order 1994 (“the principal order”) so as to designate the whole of the London Borough of Barnet (excluding the roads named or decribed in the Schedule) as a special parking area for the purposes of Part II of the Road Traffic Act 1991 with effect from 28th November 1994. The new area subsumes the three special parking areas designated by the principal order.
