The Police (Amendment) (No.3) Regulations 1994 (S.I. 1994/2331) introduced new pay arrangements for members of police forces. Those Regulations (“the No.3 Regulations”) came into force on 30th September but had effect as from 1st September.
For constables joining the police at 22 years old or older, the rate of pay before 1st September was £16,044. Under the new arrangements the rate for new constables, irrespective of age, is £13,992. Constables joining at age 22 or over after 31st August but before 30th September would thus have received less than they would have done if the No.3 Regulations had not had retrospective effect. Section 33(4) of the Police Act 1964 allows retrospection but is not to “be construed as authorising pay or allowances payable to any person to be reduced retrospectively”. Since the No.3 Regulations would have had that effect for constables in this category, these further amending Regulations are necessary to restore their entitlement to an initial rate of £16,044.
