TELECOMMUNICATIONS

The Telecommunication Meters (Approval Fees) (BABT) (Amendment) Order 1994

The Secretary of State, in exercise of the power conferred on him by section 24(13) of the Telecommunications Act 19841 and of all other powers enabling him in that behalf, hereby makes the following Order:

This Order may be cited as the Telecommunication Meters (Approval Fees) (BABT) (Amendment) Order 1994 and shall come into force on 3rd January 1995.

In this Order—

  • “application fee” has the meaning given by article 3(a) of the principal Order;

  • BABT” means the British Approvals Board for Telecommunications;

  • “continuation fee” has the meaning given by article 3(b) of the principal Order;

  • “the principal Order” means the Telecommunication Meters (Approval Fees) (British Approvals Board for Telecommunications) Order 19922.

Article 4(2)(a) of the principal Order is amended,

a

in respect of any work carried out by BABT on or after 3rd January 1995 in the exercise by it of the function of considering applications for which an application fee may be charged, and

b

in respect of the exercise by BABT on or after 3rd January 1995 of the function of being satisfied that a requirement is being complied with for which a continuation fee may be charged,

by deleting “£43.24” and substituting “£50.68”.

Article 4 of the principal Order is amended:

a

in paragraph (2) by deleting sub-paragraph (b) and substituting the following sub-paragraph:

b

an amount equal to the value added tax chargeable on the supply made in the exercise of that function.

by deleting paragraph (3) and substituting the following paragraph:

For the purposes of this article, the value of the supply made in the exercise of the relevant function by reference to which value added tax is chargeable shall be the amount calculated in accordance with paragraph (2)(a) above.

This Order amends the Telecommunication Meters (Approval Fees) (British Approvals Board for Telecommunications) Order 1992 so as to increase the fees payable for the approval and monitoring of telecommunication meters from £43.24 per man-hour to £50.68 per man-hour. It also makes minor drafting amendments.
