Whereas the European Convention on Extradition (“the Convention”)(1) opened for signature at Paris on 13th December 1957 entered into force for the United Kingdom on 14th May 1991:

And whereas the United Kingdom’s second reservation to Article 12 of the Convention was withdrawn by letter dated 18th June 1991, registered at the Secretariat General of the Council of Europe on 21st June 1991:

Now, therefore, Her Majesty, in exercise of the powers conferred on Her by section 4(1) of the Extradition Act 1989(2), is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

1.  This Order may be cited as the European Convention on Extradition (Amendment) Order 1994 and shall come into force on a date to be notified in the London, Edinburgh and Belfast Gazettes.

2.  The European Convention on Extradition Order 1990(3) shall be amended by the deletion in Schedule 4 to that Order of the second reservation to Article 12 of the Convention.

Explanatory Note

(This note is not part of the Order)

This Order amends the European Convention on Extradition Order 1990 by deleting the United Kingdom’s second reservation to Article 12 of the European Convention on Extradition. This reservation, which required an extradition request to be supported by the original of the conviction and sentence or detention order, or of the warrant of arrest or other order having the same effect, was withdrawn by the United Kingdom on 18th June 1991. A corresponding change to the Extradition Act 1989 was made by an amendment contained in paragraph 37 of Schedule 9 to the Criminal Justice and Public Order Act 1994. This Order will come into force on a date to be notified in the London, Edinburgh and Belfast Gazettes to coincide with the coming into force of the amendment to the 1989 Act.
