Explanatory Note

(This note is not part of the Order)

This Order brings into force for all purposes most of those provisions in Part I of the Police and Magistrates' Courts Act 1994 (which concerns the arrangements for policing in England and Wales) which are not currently in force or, as the case may be, which are in force for certain purposes only. The provisions which are not included in this Order and not in force relate to police discipline (including the police appeals tribunals).

Article 4 of, and the Schedule to, this Order brings most of the provisions in Part I of the 1994 Act into force on 1st April 1995. This is subject to transitional provisions in articles 4 and 5. Article 6 provides for the transfer of civilian staff (police officers remain under the direction and control of the chief constable). Article 7 provides for the transfer of all the property, rights and liabilities of an old police authority to the new where the old police authority is currently a separate body corporate. Articles 8 and 9 provide for such transfers where the police authority is currently a committee of a county council as well as for transfers from constituent councils of a combined police authority. Article 10 provides for a person nominated under article 6(4) or 8(5) to determine any dispute arising under article 6 or 8. Article 11 makes provision in respect of a dispute arising under article 8 about loan debt incurred by a county council in its capacity as police authority and creates an obligation on the new police authority to repay such debt.
