The Secretary of State, in exercise of the powers conferred on him by section 43(4) of the Broadcasting Act 1990(1), hereby makes the following Order:
1. This Order may be cited as the Broadcasting (Prescribed Countries) Order 1994 and shall come into force on 14th March 1994.
2. The countries listed in the Schedule to this Order are hereby specified as prescribed countries for the purposes of section 43(4) of the Broadcasting Act 1990.
3. The Broadcasting (Prescribed Countries) Order 1991(2) and the Broadcasting (Prescribed Countries) (Amendment) Order 1993(3) are hereby revoked.

The Broadcasting Act 1990 describes one type of television service programme under that Act as a non—domestic satellite service. Part of the definition of this service is that it consists in the transmission of television programmes by satellite for general reception in the United Kingdom or in any prescribed country (or both) where the programmes are transmitted from a place which is either in the United Kingdom or is neither in the United Kingdom nor in any prescribed country.
A prescribed country is any country specified as such in this Order.
This Order revokes and re—enacts the Broadcasting (Prescribed Countries) Order 1991 and the Broadcasting (Prescribed Countries) (Amendment) Order 1993 with amendments consisting of the addition of certain countries.
Countries are prescribed by this Order as one of the steps necessary to implement—
(a)Council Directive 89/552/EEC(4) on the coordination of certain provisions laid down by law, regulation or administrative action in Member States concerning the pursuit of television broadcasting activities as extended by the Agreement on the European Economic Area signed at Oporto on 2nd May 1992(5) together with the Protocol adjusting that Agreement signed at Brussels on 17th March 1993(6); and
(b)the European Convention on Transfrontier Television(7).
