The Secretary of State for Transport makes this Order in exercise of powers conferred on him by section 10 of the Highways Act 19801, and now vested in him2, and of all other enabling powers:–

This Order may be cited as the A564 Trunk Road (Stoke–Derby Route) (Derby Southern Bypass, Derby Spur, Junctions and Slip Roads) Amendment Order 1994 and shall come into force on 29th March 1994.

The Orders specified in the Schedule to this Order shall have effect with the amendments contained in that Schedule.

THE SCHEDULEAMENDMENTS OF ORDERS

In the A564 Trunk Road (Stoke–Derby Route) (Derby Southern Bypass and Slip Roads) (No.1) Order 19923

a

at the end of article 2 there is inserted –

and plan HA10/EM102 and, as respects the deposited plan, there shall be disregarded–

a

so much of the heavy black line indicating the centre line of the main new trunk road as relates to the length of that road which lies between point A on that plan and a point 250 metres east of point A;

b

the heavy black lines given the reference numbers 1 to 5 inclusive

in article 4(2) after the definition of “the deposited plan” there is inserted–

“plan HA10/EM102” means site plans 1 and 3 contained in the plan folio numbered HA10/EM102 marked “The A564 Trunk Road (Stoke–Derby Route) (Derby Southern Bypass, Derby Spur, Junctions and Slip Roads) Amendment Order 1994”, signed by authority of the Secretary of State for Transport and deposited at the Department of Transport, Romney House, 43 Marsham Street, London SW1P 3PY;

c

in Schedule 2 for the words “the deposited plan” wherever they occur there are substituted the words “plan HA10/EM102”; and

d

in paragraph (b)(i) of Schedule 2 for the number “160” there is substituted the number “150”.

In the A564 Trunk Road (Stoke–Derby Route) (Derby Southern Bypass) (Burnaston Slip Roads) Order 19924 for the definition of “the deposited plan” in article 4(2) there is substituted–

  • “the deposited plan” means site plan 2 contained in the plan folio numbered HA10/EM102 marked “The A564 Trunk Road (Stoke–Derby Route) (Derby Southern Bypass, Derby Spur, Junctions and Slip Roads) Amendment Order 1994”, signed by authority of the Secretary of State for Transport and deposited at the Department of Trans– port, Romney House, 43 Marsham Street, London SW10 3PY;

and the centre line of each of the slip roads is identified by a heavy black line on plan No HA10/EM102, so that the lines given the reference numbers 1 to 7 inclusive on the deposited plan shall be disregarded

in article 5(2) after the definition of “the deposited plan” there is inserted–

in Schedule 1 for the words “to cross the A6 Trunk Road and includes a roundabout, the centre of which is at a point about 360 metres north–west of the junction of the driveway to Elvaston Castle and the A6 Trunk Road and 80 metres south–west of the A6 Trunk Road, to connect with the A6 Trunk Road.”, there are substituted the words “to connect with the A6 Trunk Road by means of a roundabout the centre point of which is at a point on the A6 Trunk Road, measured in a straight line on a horizontal plane, about 710 metres north–west of its junction with Snelsmoor Lane.”;
