The Secretary of State for Transport, in exercise of the powers conferred by sections 54(1), 61 and 63 of the Road Traffic Act 19881, and of all other powers enabling him in that behalf, and after consultation with representative organisations in accordance with section 195(2) of that Act, hereby makes the following Regulations:—

Citation and commencement1

These Regulations may be cited as the Motor Vehicles (Type Approval) (Great Britain) (Amendment) Regulations 1995 and shall come into force on 12th June 1995.

Preliminary2

The Motor Vehicles (Type Approval) (Great Britain) Regulations 19842 shall be further amended in accordance with the following provisions of these Regulations.

Amendments to regulation 4 (application of type approval requirements)3

Regulation 4 shall be amended as follows.

In paragraph (1A), for the words “exhaust emissions from any vehicle,” onwards there shall be substituted the words “exhaust emissions from any vehicle (other than a vehicle with fewer than 4 wheels or fuelled solely by liquid petroleum gas), or to noise emissions from any vehicle.”.

In paragraph (2), for the words “If a vehicle or a vehicle part” there shall be substituted the words “Save as provided in paragraph (2A) of this regulation, if a vehicle or vehicle part”.

After paragraph (2) there shall be inserted the following paragraph—

The provisions of paragraph (2) of this regulation do not apply in respect of item 14H in Part I of Schedule I.

In paragraph (3A), for “4F and 4G” there shall be substituted “4F, 4G, 4K, 14E and 14F”.

In paragraph (11), for “4G and 27” there shall be substituted “4G, 4K, 14E, 14F and 27”.

Amendments to Part I of Schedule 14

Part I of Schedule 1 shall be amended as follows.

In item 4K, in column (6), there shall be inserted “See regulation 4(11) and Schedule 1B.” opposite “1.10.1993” in both places where it occurs in column 5.

After item 4K there shall be inserted the item set out in Schedule 1 to these Regulations.

In item 14E, in column 6, there shall be inserted “See regulation 4(11) and Schedule 1B.”, opposite “1.10.1987” and “1.10.1993” in column 5.

In item 14F, in column 6, there shall be inserted “See regulation 4(11) and Schedule 1B.”.

After item 14G there shall be inserted the item set out in Schedule 2 to these Regulations.

Part I of Schedule 1B shall be amended as follows.

These Regulations further amend the Motor Vehicles (Type Approval) (Great Britain) Regulations 1984.

Regulation 4 of the 1984 Regulations is amended so that from 12th June 1995, the type approval requirements relating to noise emissions then in force shall apply to a vehicle regardless of the date of manufacture.

The type approval requirements relating to exhaust emissions are revised so as to—

a

introduce the requirements of Directive 94/12/EC as a new alternative; and

b

provide for the standard to become mandatory by removing the option of complying with Council Directive 93/59/EEC or ECE Regulation 83 as amended, from 1st January 1996 for new vehicle types and from 1st January 1997 for existing types.

The type approval requirements relating to noise are revised so as to provide for the requirements of Council Directive 92/97/EEC to become mandatory by removing the option of complying with Council Directive 84/424/EEC or ECE Regulation 51 as amended, from 1st October 1995 for new vehicle types and from 1st October 1996 for existing types.

A relaxation of the requirements of Council Directive 92/97/EEC with regard to exhaust systems containing fibrous materials is introduced as an option for low volume type approval vehicles.
