In exercise of the powers conferred on the Secretary of State by sections 172(6) and 301(6) of, and paragraph 2 of Schedule 9 to, the Education Act 1993(1) the Secretary of State for Education hereby makes the following Regulations:—
1. These Regulations may be cited as the Education (Special Educational Needs) (Amendment) Regulations 1995 and shall come into force on 14th August 1995.
2.—(1) The Education (Special Educational Needs) Regulations 1994(2) shall be amended as follows.
(2) In regulation 3(a) after the words “qualified teacher” there shall be inserted the words “within the meaning of section 218 of the Education Reform Act 1988(3)”.
(3) In regulation 7(2) for the words “in paragraph (1)” there shall be substituted the words “in paragraph (1)(a) to (c)”.
(4) In regulation 21(10)(a) and (b) for the words “commenced after 1st September 1994” in both places where they occur there shall be substituted the words “to which regulations 15 to 17 apply”.

These regulations amend the Education (Special Educational Needs) Regulations 1994. Apart from a drafting amendment the amendments define “qualified teacher” in regulation 3(a) and relate to the transitional provisions governing annual reviews of statements of special educational needs.
