This Order gives effect to recommendations by the Local Government Commission for England in respect of the making of changes to the structure of local government in the county of Cleveland.
Article 3 effects the structural change by providing for the abolition of the county council of Cleveland on 1st April 1996 and the transfer of its functions, in relation to each borough in the county, to the council of the borough.
Article 4 makes provision for the purposes of subordinate legislation to be made under the Fire Services Act 1947 in respect of fire services in Cleveland.
Article 5 makes transitional provision in relation to appointments to, and the discharge of certain functions by, the Cleveland Police Authority before 1st April 1996.
Article 6 makes provision with respect to the county council’s structure plan and to enable the local plans prepared by the borough councils under the Town and Country Planning Act 1990 to contain minerals and waste policies.
Article 7 designates Middlesbrough Borough Council for the purposes of certain finance functions.
Article 8 vests the county council’s superannuation fund in the Middlesbrough Borough Council.
Article 9 provides for the change of name of the borough of Langbaurgh-on-Tees.
Articles 10 to 12 make provision with respect to preparations for implementation of the reorganisation and article 13 amends the Borough of Hartlepool (Electoral Arrangements) Order 1975 to make provision for a whole council election in Hartlepool in 1995 and for reversion to election by thirds in subsequent years.
The Schedule makes provision in respect of the North York Moors National Park.
