SCHEDULE FORM OF NOTICE OF PROPOSAL

“SCOTTISH CHARITIESNOTICE OF PROPOSAL TO TRANSFER DORMANT ACCOUNTS

1.   I [name and address], the Scottish charities nominee appointed by the Secretary of State for Scotland, in terms of section 12(1) of the Law Reform (Miscellaneous Provisions) (Scotland) Act 1990 (“the Act”), have been informed that the accounts held by the relevant institutions specified in the Table below in the name of or on behalf of the bodies listed in that Table are dormant accounts. I am satisfied that each of the listed bodies is a recognised body for the purposes of the Act.

2.   It appears to me that, in the case of each listed body not marked with an asterisk in the Table below, section 12(3) of the Act may apply because—

(a) the amount standing to the credit of the body in those accounts is less than £5,000;

(b) there may be no person concerned in the management or control of the body; and

(c) there may be no circumstances relating to the body which would make it inappropriate for me to transfer the balance standing to its credit in those accounts to another recognised body.

In the case of any listed body marked with an asterisk in the Table section 12(3) applies by virtue of section 12(6) of the Act.

3.   Accordingly, I propose to transfer the balance standing to the credit of each of the listed bodies in those accounts to the recognised body specified opposite its name in the Table below

(a) in terms of section 12(3) of the Act, where I have had regard to the purposes of the listed body so far as known to me; and

(b) in terms of section 12(4) of that Act, where I have been unable to ascertain what those purposes are.

4.   Any person wishing to make representations about any matter in connection with this notice may do so by sending them to me, in writing, at the address mentioned above, within one month of the date of publication of this notice.
