Provisions coming into force on 12th October 19952

The following provisions of the Environment Act 1995 shall come into force on 12th October 1995:—

a

section 20 (the Scottish Environment Protection Agency);

b

section 21 (transfer of functions to SEPA);

c

section 22 (transfer of property, rights and liabilities to SEPA);

d

section 23 (functions of staff commission);

e

section 30 (records held by SEPA);

f

section 31 (guidance on sustainable development and other aims and objectives);

g

section 32 (general environmental and recreational duties);

h

section 36 (codes of practice with respect to environmental and recreational duties);

i

section 59 (abandoned mines; Scotland), in so far as the amendments made by that section confer power on the Secretary of State to make regulations; and

j

section 120(1) (minor and consequential amendments), in so far as it relates to the following provisions of Schedule 22:—

i

paragraph 15;

ii

sub-paragraphs (1) and (22) of paragraph 29, in so far as the amendments made by those provisions confer power on the Secretary of State to make regulations;

iii

sub-paragraphs (1) to (3) and (5) of paragraph 51; and

iv

paragraph 53.
