Under Section 63 of the Environment Act 1995 the Secretary of State may by order establish for a National Park an authority (known as a National Park authority) to carry out in relation to that Park the functions conferred on such an authority by or under Part III of that Act. A National Park authority is a body corporate (see Schedule 7 paragraph 1(1) to that Act of 1995).

SCHEDULE 5 Application of other enactments and instruments with modifications

Section 177 of the 1972 Act2

In section 177 of the 1972 Act (provisions supplementary to sections 173 to 176) paragraph (b) of subsection (1) M1 shall have effect as if a National Park authority were a body specified in section 21(1) of the 1989 Act as referred to in paragraph (a) of subsection (1) of section 177.
