Whereas in pursuance of section 3(1) of the Parliamentary Constituencies Act 19861 and section 28(2) of the Northern Ireland Constitution Act 19732, the Boundary Commission for Northern Ireland have submitted to the Secretary of State a report dated 20th June 1995 showing the constituencies into which they recommend, in accordance with that Act, that Northern Ireland should be divided, together with a supplementary report showing the number of members that they recommend should be returned to the Northern Ireland Assembly for each of those constituencies;

And whereas the Secretary of State has laid the report and supplementary report before Parliament together with the draft of this Order in Council to give effect, without modifications, to the recommendations contained in the report and supplementary report and each House of Parliament has by resolution approved the said draft;

Now, therefore, Her Majesty, in pursuance of section 4 of the Parliamentary Constituencies Act 1986 (as enacted and as applied by section 28(4) of the Northern Ireland Constitution Act 19733) and section 28(5) of the Northern Ireland Constitution Act 19734, is pleased, by and with the advice of Her Privy Council, to order, and it is hereby ordered, as follows:

This Order may be cited as the Parliamentary Constituencies (Northern Ireland) Order 1995.

Subject to section 4(6) of the Parliamentary Constituencies Act 1986 and section 28(6) of the Northern Ireland Constitution Act 19735, this Order shall come into force on the fourteenth day after the day on which it is made.

For all the constituencies in Northern Ireland there shall be substituted the constituencies which—

a

are named in the left-hand column of the Schedule to this Order;

b

are designated in that column as either county constituencies or borough constituencies; and

c

comprise the areas set out in the right-hand column of that Schedule.

The areas set out in the right-hand column of the Schedule to this Order are local government areas as they existed on 1st June 1994.

Section 1(1) of the Northern Ireland Assembly Act 19736 shall be amended by the substitution of the words “90 members” for the words “85 members”.

This Order gives effect without modification to the recommendations set out in the report and supplementary report of the Boundary Commission for Northern Ireland dated 20th June 1995. The report sets out proposals for parliamentary constituencies in Northern Ireland consequent on a review by the Commission of the representation in the House of Commons of Northern Ireland.

Article 2 of, and the Schedule to, this Order give effect to those proposals. By virtue of section 4(6) of the Parliamentary Constituencies Act 1986, the coming into force of this Order does not affect any parliamentary election until a proclamation is issued by Her Majesty summoning a new Parliament, or affect the constitution of the House of Commons until the dissolution of the Parliament then in being.

Article 3 of this Order amends the Northern Ireland Assembly Act 1973 in consequence of giving effect to the recommendations in the supplementary report. Article 3(1) amends section 1(1) of that Act so that any future Northern Ireland Assembly shall consist of 90 members. Article 3(2) amends the Schedule to that Act by setting out the new constituencies and the number of members to be returned for each.
