37. After regulation 35 of the Maintenance Assessment Procedure Regulations (periods for compliance), there shall be inserted the following regulation—
35A. A child support officer shall not after 22nd January 1996 give a reduced benefit direction where—
(a)income support is paid to or in respect of the parent in question and the applicable amount of the claimant for income support includes one or more of the amounts set out in paragraph 15(3), (4) or (6) of Part IV of Schedule 2 to the Income Support (General) Regulations 1987(1); or
(b)an amount equal to one or more of the amounts specified in sub-paragraph (a) is included, by virtue of regulation 9 of the Maintenance Assessments and Special Cases Regulations, in the exempt income of the parent in question and family credit or disability working allowance is paid to or in respect of that parent.”.
