Amendment of regulation 21 of the Income Support Regulations21
In regulation 21 of the Income Support Regulations (special cases)25—
a
in paragraph (3)—
i
for the definition of “prisoner” the following definition shall be substituted—
“prisoner” means a person who—
- a
is detained in custody pending trial or sentence upon conviction or under a sentence imposed by a court; or
- b
is on temporary release in accordance with the provisions of the Prison Act 195226 or the Prisons (Scotland) Act 198927,
other than a person whose detention is under the provisions of the Mental Health Act 198328 or the Mental Health (Scotland) Act 198429;
ii
in sub-paragraph (a) of the definition of “residential accommodation” the words “and 26” shall be omitted;
b
in paragraph (3B), the words “and 26” shall be omitted;
c
in paragraph (4), sub-paragraph (b) and the word “or” immediately following that sub-paragraph shall be omitted.
