LEGAL AID AND ADVICE, ENGLAND AND WALES

These Regulations amend the Legal Aid in Criminal and Care Proceedings (General) Regulations 1989 by—requiring magistrates' courts to provide copies of legal aid application forms free of charge;requiring the proper officer of each court to which applications for criminal legal aid are made to keep records of the applications, showing the court’s reasons for holding that legal aid should or should not be granted in the interests of justice, referring where appropriate to the criteria listed in section 22 of the Legal Aid Act 1988;requiring the proper officer to supply the applicant with a copy of that record where legal aid has been refused on the interests of justice ground;exempting the applicant from the duty of providing a statement of means in a case where no means test applies because he, his parent or guardian or the spouse of one of these receives income support, family credit or disability working allowance.
