The Secretary of State, in exercise of the powers conferred upon him by paragraph 1A(3) of Schedule 3 to the Environmental Protection Act 19901, sections 70(2) and (3) and 104(1) of the Control of Pollution Act 19742 and of all other powers enabling him in that behalf, hereby makes the following Regulations:
