The Disability Discrimination Act 1995 (Commencement No.2) Order 1996

The Secretary of State for Social Security, in exercise of the powers conferred upon him by section 70(3) of the Disability Discrimination Act 19951, and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation1

This Order may be cited as the Disability Discrimination Act 1995 (Commencement No.2) Order 1996.

Appointed day2

The day appointed for the coming into force of the provisions of the Disability Discrimination Act 1995 specified in article 3 below is 17th May 1996.

Provisions commenced3

The provisions referred to in article 2 above are—

a

section 1 (Meaning of “disability” and “disabled person”);

b

section 2 (Past disabilities);

c

section 3 (Guidance);

d

section 16(3) in so far as it relates to the definitions of “sub-lease” and “sub-tenancy”, and (5) in so far as it relates to paragraph 4 of Schedule 4 (Sub-leases etc);

e

section 28 (Provision of advice and assistance);

f

section 59 (Statutory authority and national security);

g

section 62(1), (2) and (7) (Restriction of publicity: industrial tribunals);

h

section 63(1), (2), (4), (5) and (6) (Restriction of publicity: Employment Appeal Tribunal);

i

section 67 (Regulations and orders);

j

section 68(1) (Interpretation);

k

section 69 (Financial provisions);

l

section 70(7) (House of Commons disqualification);

m

Schedule 1 (with the exception of paragraph 7) (Provisions Supplementing Section 1);

n

Schedule 2 (Past Disabilities);

o

Schedule 4, paragraph 4 (Sub-leases etc.).

This Order brings into force on 17th May 1996 certain provisions of the Disability Discrimination Act 1995 relating to the definition of disability; past disabilities; guidance; definition of lease, sub-lease and sub-tenancy; advice and assistance; statutory authority and national security; restriction of publicity in industrial tribunals and the Employment Appeal Tribunal; regulations and orders; interpretation; financial provisions; House of Commons disqualification; provisions supplementing the definition of disability and past disabilities.

The Disability Discrimination Act 1995 (Commencement No.1) Order 19952 brought into force on 1st January 1996 sections 50, 51 and 52 of, and Schedule 5 to, the Disability Discrimination Act 1995.
