Offences and penalties10

It shall be an offence for a person—

a

without reasonable excuse, to fail to comply with the provisions of regulation 5;

b

intentionally to obstruct an authorised person in the exercise of a power conferred by regulation 6; or

c

without reasonable excuse, to fail to comply with a request made under regulation 7.

It shall be an offence for a person to furnish information recklessly or which he knows to be false or misleading in a material particular—

a

in connection with any requirement imposed under regulation 6; or

b

for the purpose of obtaining for himself or another person the whole or part of any payment.

A person guilty of an offence under paragraph (1)(a) above shall be liable on summary conviction to a fine not exceeding level 3 on the standard scale.

A person guilty of an offence under paragraph (1)(b) or (c) or (2) of this regulation shall be liable on summary conviction to a fine not exceeding level 5 on the standard scale.
