168.—(1) Regulation 3 of the Social Security Benefit (Members of the Forces) Regulations 1975(1) (unemployment benefit) shall be amended in accordance with the following provisions of this regulation.
(2) In paragraph (1) for the words from “shall be disqualified” to the end of the paragraph there shall be substituted the words “shall be treated for the purposes of section 19 of the Jobseekers Act 1995(2) (circumstances in which a jobseeker’s allowance is not payable) as though he has lost his employment through misconduct.”.
(3) For paragraph (2) there shall be substituted the following paragraph–
“(2) Section 19(6)(b) and (d) of the Jobseekers Act 1995 (jobseeker’s allowance not payable where claimant has voluntarily left employment or neglected to avail himself of a reasonable opportunity of employment) shall not apply to a claimant who whilst a serving member of the forces is discharged at his own request.”.
(4) In paragraph (3) for the words “unemployment benefit” there shall be substituted the words “a jobseeker’s allowance”.
