170.—[F1(1) A person who is not receiving training falling within paragraph (2) [F2and is not a qualifying young person or child within the meaning of section 142 of the Benefits Act (child and qualifying young person)] may be entitled to an income-based jobseeker’s allowance without—
(a)being available for employment;
(b)having entered into a jobseeker’s agreement; or
(c)actively seeking employment,
if he is in receipt of a training allowance F3....]
(2) Training falls within this paragraph if it is training for which persons aged under 18 are eligible and for which persons aged 18 to 24 may be eligible, [F4secured by the [F5[F6Young People’s Learning Agency for England] [F6Secretary of State], the Chief Executive of Skills Funding] or by the [F7Welsh Ministers] and, in Scotland, provided], directly or indirectly by a Local Enterprise Company pursuant to its arrangement with, as the case may be, [F8Skills Development Scotland,] Scottish Enterprise Highlands and Island Enterprise (whether that arrangements is known as am Operating Contract or by other name).
