The Asylum and Immigration Act 1996 (Commencement No. 2) Order 1996

In exercise of the powers conferred upon him by section 13(3) of the Asylum and Immigration Act 19961, the Secretary of State hereby makes the following Order:

This Order may be cited as the Asylum and Immigration Act 1996 (Commencement No. 2) Order 1996.

In this Order “the Act” means the Asylum and Immigration Act 1996.

The provisions of the Asylum and Immigration Act 1996 specified in Part I of the Schedule to this Order shall come into force on 19th August 1996; the provisions specified in Part II of the Schedule shall come into force on 7th October 1996; the provision specified in Part III of the Schedule shall come into force on 21st October 1996; and the provisions specified in Part IV of the Schedule shall come into force on 1st November 1996.

Amendments of the Immigration Act 1971

(This note is not part of the Order)

This Order brings into force on 19th August 1996 section 9 of the Asylum and Immigration Act 1996 (entitlement to housing accommodation and assistance), apart from those parts of the section which were brought into force on 26th July 1996, and section 10 for the purpose of prescribing conditions for eligibility for child benefit. It brings section 10 of the Act into force on 7th October 1996 together with the power in section 1 to prescribe by Order countries or territories in which it appears to the Secretary of State that there is in general no serious risk of persecution. Section 1 (extension of special asylum appeal procedures) is brought into force on 21st October 1996; and paragraphs 1(1) and 3(1) of Schedule 2 (conditions about recourse to public funds) come into force on 1st November 1996.
