Coming into force
The Secretary of State for Health, in exercise of the powers conferred on him by section 92(1) of the National Health Service Act 19771 and of all other powers enabling him in that behalf, having regard to the change in the arrangements for the administration of hospitals and other establishments and facilities previously managed by the former East Riding Health Authority resulting from the establishment of the East Yorkshire Community Healthcare National Health Service Trust2, having consulted the East Riding Health Authority3 and that Trust in accordance with section 92(3) of that Act, hereby makes the following Order:
Citation, commencement and interpretation1

This Order may be cited as the East Yorkshire Community Healthcare National Health Service Trust (Transfer of Trust Property) Order 1996 and shall come into force on 16th December 1996.

In this Order—
“the Authority” means the East Riding Health Authority established on 1st April 19964;
“the old Authority” means the East Riding Health Authority established on 1st April 19935 and abolished on 1st April 19966;
“the Trust” means the East Yorkshire Community Healthcare National Health Service Trust;
“the trust property” means the items specified in a schedule of trust property prepared by and agreed upon by the old Authority and the Trust on 20th December 1995, which schedule has been signed on behalf of both the old Authority and the Trust.
Transfer of trust property2
On 16th December 1996 the trust property shall be transferred from the Authority to the Trust.
