This Order varies the prohibition contained in article 4 of the Upper Spey and Associated Waters Protection (Renewal) Order 1993 (“the 1993 Order”) which prohibits fishing for or taking freshwater fish in inland waters in the area prescribed without legal right or without written permission from someone having such a right.
The effect of the variation is to continue the 1993 Order in force for an unlimited period.
The prescribed area referred to consists of those parts of the catchment areas of the Rivers Spey, Spean and Tummel lying within Highland and Tayside Regions. The area is illustrated on a map attached to the Upper Spey and Associated Waters Protection Order 1982 (“the 1982 Order”) and is defined by reference to a detailed large scale map which may be inspected at the Scottish Office Agriculture, Environment and Fisheries Department, Pentland House, Robb’s Loan, Edinburgh on any working day between 10.00am and 4.00pm.
The map annexed to and forming part of this note gives a general guide to the boundaries of the prescribed area.
The 1982 Order was renewed in accordance with the Orders listed in the footnote to article 2.
