3. Section 62 (special provision with respect to certain dangerous and intractable waste) of the 1990 Act(1) shall have effect, without modification, so as to empower the Secretary of State to make provision for waste which would be controlled waste but for the fact that it is radioactive waste within the meaning of the Radioactive Substances Act 1993(2); and paragraphs (1) and (2) of regulation 2 shall apply to any such waste as if it were controlled waste.
Section 62 is amended by paragraph 80 of Schedule 22 to the Environment Act 1995 (c. 25).
1993 c. 12. Section 78 of the Environmental Protection Act 1990 (which is amended by paragraph 7 of Schedule 4 to the Radioactive Substances Act 1993) provides that Part II of the 1990 Act does not apply to radioactive waste as defined in the 1993 Act save to the extent that the Secretary of State so provides in regulations.
