The Wellhouse National Health Service Trust (Establishment) Amendment Order 1996

Coming into force

The Secretary of State for Health, in exercise of powers conferred on him by section 126(3) of the National Health Service Act 19771 and section 5(1) of the National Health Service and Community Care Act 19902 and of all other powers enabling him in that behalf, hereby makes the following Order:

Citation and commencement1

This Order may be cited as the Wellhouse National Health Service Trust (Establishment) Amendment Order 1996, and shall come into force on 6th April 1996.

Amendment of Establishment Order2

In Article 3 of the Wellhouse National Health Service Trust (Establishment) Order 19913 (functions of the trust)—

a

in paragraph (1) for “section 5(1)(a)” there shall be substituted “section 5(1)(b)”; and

b

in paragraph (2) for “own and manage” there shall be substituted “provide and manage”.

This Order amends the Order which established the Wellhouse National Health Service Trust to alter the purpose for which the trust has been established and to amend its functions. (The trust has, in exercise of its existing functions, assumed responsibility for the ownership and management of the Edgware General Hospital and associated hospitals, previously managed by the Barnet Health Authority.)

This Order confers on the trust the purpose specified in section 5(1)(b) of the National Health Service and Community Care Act 1990— to provide and manage hospitals or other establishments or facilities— and amends the trust’s functions so that it is no longer required to own the premises at which it is to provide hospital accommodation and services.
