Coming into force
The Secretary of State for Wales, in exercise of the powers conferred on him by sections 2(9) and 15(5) of the Local Government Act 19881, and of all other powers enabling him in that behalf, hereby makes the following Order:
Citation, commencement and application1

This Order may be cited as the Local Government Act 1988 (Defined Activities) (Works Contracts) (Exemptions) (Wales) Order 1997 and shall come into force on 14th August 1997.

This Order applies only in relation to the following defined authorities2 in Wales—
a
a local authority3;
b
a combined fire authority;
c
a National Park authority4; and
d
a joint committee which falls to be treated as a defined authority by section 1(4) of the Local Government Act 1988 and which is appointed only by two or more defined authorities within paragraph (a), (b) or (c) above.
Works contracts2
The provision of services specified in column (1) of the Schedule to this Order shall not be treated as a defined activity so long as it is carried out in pursuance of a works contract5 by a defined authority for another defined authority before the date specified in relation to those services in column (2) of that Schedule.
