This Order appoints 1st October 1997 for the purposes of section 49 of the Criminal Procedure and Investigations Act 1996 (either way offences: accused’s intention as to plea).

This Order appoints 1st October 1997 for the purposes of section 49 of the Criminal Procedure and Investigations Act 1996 (either way offences: accused’s intention as to plea).
Section 49 extends to England and Wales only and applies where a person appears or is brought before a magistrates' court on or after 1st October 1997, unless he has appeared or been brought before such a court in respect of the same offence on a previous occasion falling before that date (section 49(6)).
