The Mink (Keeping) (Amendment) Regulations 1997

The Minister of Agriculture, Fisheries and Food, the Secretary of State for Scotland and the Secretary of State for Wales, acting jointly, in exercise of the powers conferred on them by section 2(c) of the Destructive Imported Animals Act 1932(1), as applied in relation to mink by the Mink Keeping Order 1992(2), and now vested in them(3), and of all other powers enabling them in that behalf, and with the approval of the Treasury, hereby make the following Regulations:

Title and commencement

1.  These Regulations may be cited as the Mink (Keeping) (Amendment) Regulations 1997 and shall come into force on 1st January 1998.

Amendment of the principal Regulations

2.  The Mink (Keeping) Regulations 1975(4) shall be amended in regulation 5 by the substitution for paragraph (3) thereof (fee payable in respect of the granting of a licence in accordance with section 3 of the Act) of the following paragraph—

(3) On the granting of a licence in accordance with section 3 of the Act or, as the case may be, section 8 of the Act, there shall be paid to the Minister of Agriculture, Fisheries and Food, the Secretary of State for Wales or the Secretary of State for Scotland, as the case may be, the following fee—

(a)in the case of a licence granted in accordance with section 3 of the Act, £630; and

(b)in the case of a licence granted in accordance with section 8 of the Act—

(i)in England and Wales, £185; and

(ii)in Scotland, £60.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Mink (Keeping) Regulations 1975 (as amended) in respect of the fees prescribed in respect of licences to keep mink, with effect from 1st January 1998. In the case of a special licence to keep mink for exhibition or for purposes of scientific research or other exceptional purposes, granted under section 8 of the Destructive Imported Animals Act 1932 (“the Act”), they prescribe a fee of £185 in England and Wales, and £60 in Scotland. In the case of a licence granted under section 3 of the Act (all other cases in which a licence is granted), they prescribe a fee of £630.

Prior to the entry into force of these Regulations, the Mink (Keeping) Regulations 1975 were last amended by the Mink (Keeping) (Amendment) Regulations 1987 (S.I. 1987/2225), which prescribed a fee of £115 in respect of a licence granted under section 3 of the Act. No fee has previously been prescribed in respect of the granting of a licence under section 8 of the Act.
