Recovery from local funds in respect of maintenance grant paid to a grant-maintained special school outside the local education authority’s area.
62. Regulation 23(2) of the Education (Grant-maintained Special Schools) Regulations 1994(1) (funding) shall be amended by the addition of a new sub-paragraph as follows—
“or
(d)any grant-maintained special school outside the area of the authority which, immediately before it became such a school, was maintained by a local education authority which was the subject of a structural or boundary change (or both such changes) within the meaning of section 14 of the Local Government Act 1992(2) made under section 17 of that Act.”.
