Subject to paragraph (3), all applications which have been made under the legislation referred to in paragraph (4) and which have not been concluded at the date these Regulations come into force shall be treated from then on as having been made under the relevant legislation.

All proceedings which have been commenced under the legislation referred to in paragraph (4) and which have not been concluded at the date these Regulations come into force shall be treated from then on as having been commenced under the relevant legislation.

Where, before the date on which section 5 (rights in relation to application period) comes into force, an application has been made for plant breeders' rights which is granted after that date, that section shall entitle the holder to compensation only for things done after that date.

The legislation referred to in paragraphs (1) and (2) is—

a

those provisions of the Plant Varieties and Seeds Act 1964 which are repealed by section 52 of the Act; and

b

the legislation which is revoked by regulation 21(1) and (2).
