Exemptions for vehicles used by health service bodies

3.—(1) In paragraph 2(2) of the Schedule to the Community Drivers' Hours and Recording Equipment (Exemptions and Supplementary Provisions) Regulations 1986(1) (exempted vehicles), for paragraph (a) there shall be substituted the following paragraph—

(a)is being used by a health service body—

(i)to provide ambulance services in pursuance of its duty under the National Health Service Act 1977(2), the National Health Service and Community Care Act 1990(3) or the National Health Service (Scotland) Act 1978(4); or

(ii)to carry staff, patients, medical supplies or equipment in pursuance of its general duties under that Act;.

(2) In paragraph 2(3) of that Schedule, after the definition of “harbour” and “harbour authority” there shall be inserted the following definition—

  • “health service body”—

    (a)

    in relation to England and Wales, means a Health Authority, a Special Health Authority or an NHS trust (each within the meaning of the National Health Service Act 1977);

    (b)

    in relation to Scotland, means the Agency, a Health Board, a Special Health Board or an NHS trust (each within the meaning of the National Health Service (Scotland) Act 1978).
