The Potatoes Originating in The Netherlands (Amendment) Regulations 1998

Coming into force

The Minister of Agriculture, Fisheries and Food and the Secretary of State, being Ministers designated1 for the purposes of section 2(2) of the European Communities Act 19722 in relation to the common agricultural policy of the European Community, acting jointly, in exercise of the powers conferred by the said section 2(2) and of all other powers enabling them in that behalf, hereby make the following Regulations:

Title and commencement1

These Regulations may be cited as the Potatoes Originating in The Netherlands (Amendment) Regulations 1998 and shall come into force on 18th December 1998.

Amendment of the Potatoes Originating in The Netherlands Regulations 19972

The Potatoes Originating in The Netherlands Regulations 19973 shall be amended in accordance with the following paragraphs of this regulation.

In regulation 3 (interpretation) for the definition of “originating in The Netherlands” there shall be substituted–

  • “originating in The Netherlands” means grown in 1998 in The Netherlands;

In regulation 4(3)–

a

for the words “before the commencement of these Regulations” there shall be substituted the words “before the commencement of the Potatoes Originating in The Netherlands (Amendment) Regulations 1998”; and

b

for the words “31st October 1997” there shall be substituted the words “31st December 1998”.

In regulation 4(4)–

a

for the words “before the commencement of these Regulations” there shall be substituted the words “before the commencement of the Potatoes Originating in The Netherlands (Amendment) Regulations 1998”; and

b

for the words “31st October 1997” there shall be substituted the words “31st December 1998”.

In regulation 6(1) (charges in respect of the sampling of imports of seed potatoes) for the words “a fee of £116” there shall be substituted the words “a fee of £118”.

These Regulations implement Commission Decision of 9th December 1998 amending Decision 95/506/EC authorizing Member States temporarily to take additional measures against the dissemination of Pseudomonas solanacearum (Smith) Smith as regards the Kingdom of the Netherlands by amending the Potatoes Originating in The Netherlands Regulations 1997 so that they apply to potatoes grown in 1998 in The Netherlands (regulation 2(2), (3) and (4)).

These Regulations also amend the Potatoes Originating in The Netherlands Regulations 1997 to increase the fee for sampling potatoes from £116 to £118 (regulation 2(5)).

A Regulatory Appraisal (now known as a Regulatory Impact Assessment) was prepared in relation to the Potatoes Originating in The Netherlands Regulations 1997. A separate Assessment has not been prepared in relation to these Regulations which increase the fee for sampling potatoes by less than the rate of inflation.
