The Secretary of State, in exercise of the powers conferred by section 2(1) of the Wireless Telegraphy Act 1949(1), and now vested in her(2), the power conferred on her by article 8 of the Department of Trade and Industry (Fees) Order 1988(3), and of all other powers enabling her in that behalf, hereby, with the consent of the Treasury, makes the following Regulations:

1.  These Regulations may be cited as the Wireless Telegraphy (Licence Charges) (Amendment) Regulations 1998 and shall come into force on 1st April 1998.

2.  In these Regulations, “the 1995 Regulations” means the Wireless Telegraphy (Licence Charges) Regulations 1995(4).

3.  The 1995 Regulations are hereby amended as follows:

(a) regulation 3(7) shall be deleted; and

(b) for Schedules 2 and 4, there shall be substituted respectively Schedules 1 and 2 to these Regulations.

Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Wireless Telegraphy (Licence Charges) Regulations 1995 (S.I. 1995/1331, “the 1995 Regulations”, as amended by the Wireless Telegraphy (Licence Charges) (Amendment) Regulations 1996 (S.I. 1996/1464), the Wireless Telegraphy (Licence Charges) (Amendment) Regulations 1997 S.I. 1997/1006) and the Wireless Telegraphy (Licence Charges) (Amendment No. 2) Regulations (S.I. 1997/1885)) by substituting new Schedules 2 and 4 to the 1995 Regulations. As a consequence of the substitution of new Schedule 4, regulation 3(7) is deleted.

Schedule 2 sets out the frequency band and limits of bandwidth in relation to classes of fixed link for the purpose of Schedule 4. Schedule 4 sets out the fee payable for wireless telegraphy licences granted by the Secretary of State under section 1 of the Wireless Telegraphy Act 1949 (c. 54).
