5. Without prejudice to regulation 3 of the Management of Health and Safety at Work Regulations 1992(1), an employer shall not carry on any work which is liable to expose any employees to lead at work unless he has made a suitable and sufficient assessment of whether the exposure of any employees to lead is liable to be significant.
