Explanatory Note

(This note is not part of the Regulations)

These Regulations amend the Child Support (Maintenance Assessment Procedure) Regulations 1992 (S.I. 1992/1813) (“the 1992 Regulations”) and the Child Support Departure Direction and Consequential Amendments Regulations 1996 (S.I. 1996/2907) (“the 1996 Regulations”). They are made in consequence of the amendments to the Child Support Act 1991 (c. 48) effected by the Social Security Act 1998 (c. 14) which alter the way child support decisions are made and changed at first tier.

These Regulations amend the 1992 and 1996 Regulations consequential upon the transfer to the Secretary of State of the functions of child support officers under section 13 of the Child Support Act 1991. Regulations 16 and 43 insert regulations into the 1992 Regulations and the 1996 Regulations respectively which describe when and how the Secretary of State may revise or supersede such a decision. The inserted regulations also make provision as to the date a revision or supersession takes effect. These Regulations remove or replace provisions in the 1992 and 1996 Regulations which deal with reviews of decisions and the effective date of assessments made following a review.

These Regulations do not impose a charge on business.
