The Crime and Disorder Act 1998 (Commencement No. 4) Order 1999

4th May 1999

In exercise of the powers conferred on him by section 121 of the Crime and Disorder Act 1998(1), the Secretary of State hereby makes the following Order:

1.  This Order may be cited as the Crime and Disorder Act 1998 (Commencement No. 4) Order 1999.

2.  The following provisions of the Crime and Disorder Act 1998 shall come into force on 1st June 1999:

(a)section 43 (time limits), to the extent that it is not already in force;

(b)section 44 (additional time limits for persons under 18);

(c)section 45 (re-institution of stayed proceedings);

(d)section 97 (remands and committals of children and young persons), to the extent that it is not already in force;

(e)section 98 (remands and committals: alternative provision for 15 or 16 year old boys);

(f)paragraphs 5(1)(b), 125(b) and 127(b) of Schedule 8; and

(g)in Schedule 10, the entries relating to:

(i)section 62 of the Criminal Justice Act 1991(2); and

(ii)section 20 of the Criminal Justice and Public Order Act 1994(3).

Explanatory Note

(This note is not part of the Order)

This Order brings sections 43 to 45, 97 and 98 of the Crime and Disorder Act 1998 into force on 1st June 1999. These provisions relate to time limits and to the remand and committal of children and young persons. The Order also brings into force on that date a number of minor related provisions.
