The Petroleum Act 1998 (Commencement No. 1) Order 1999

In exercise of the powers conferred on him by section 52(4) of the Petroleum Act 19981, the Secretary of State hereby makes the following Order:–

This Order may be cited as the Petroleum Act 1998 (Commencement No. 1) Order 1999.

Commencement of Petroleum Act 19982

The Petroleum Act 1998 (hereinafter referred to as “the Act”) shall come into force in accordance with section 52(4) thereof on 15th February 1999, and, accordingly, all the provisions of the Act other than the excepted provisions mentioned in the following paragraph shall come into force on that day.

The excepted provisions referred to in the preceding paragraph are–

a

section 5(1) to (4) and (11) and section 52 of the Act (which, as provided in section 52(1), came into force on the passing of the Act), and

b

paragraphs 8, 10, 11, 13, 34 and 40 of Schedule 4 and the repeals in Schedule 5 to the Act of the Employment (Continental Shelf) Act 19782, of section 287(5) of the Trade Union and Labour Relations (Consolidation) Act 19923 and of section 201(5) of the Employment Rights Act 19964 (which, as provided in section 52(2), come into force in accordance therewith).

This Order provides that the Petroleum Act 1998 shall come into force in accordance with section 52(4) thereof on 15th February 1999. Subsection (4) of section 52 is subject to subsections (1) and (2) of that section, which apply in relation to the coming into force of the “excepted provisions” mentioned in article 2(2). The Order accordingly brings into force on that date all the provisions of the Act other than those excepted provisions.

By virtue of section 48(2) of the Act, any reference therein to the commencement thereof is a reference to its commencement in accordance with this Order.
