9.  The function of the Secretary of State under section 2 of the Business Names Act 1985 (prohibition of use of certain business names) so far as relating to an individual to whom that Act applies who–U.K.

(a)has a place of business in Scotland; and

(b)carries on business in Scotland under a name to which either paragraphs (a) or (b) of subsection (1) of that section applies,

shall be treated as exercisable in or as regards Scotland and may be exercised separately.
