In section 1 (assumed rate of return for investment of damages), for subsection (5) there is substituted–

“(5)

In the application of this section to Scotland–

(a)

for the reference to the Lord Chancellor in subsections (1) and (4) there is substituted a reference to the Scottish Ministers; and

(b)

in subsection (4)–

(i)

“and the Treasury” is omitted; and

(ii)

for “either House of Parliament” there is substituted “the Scottish Parliament”.”.

In section 6 (guarantees for public sector settlements), after subsection (8A)91 there is inserted–

“(8B)

In the application of this section to Scotland, “relevant government department” shall be read as if it was a reference to any part of the Scottish Administration and subsection (8) shall cease to have effect.”.
