PART VIII AMENDMENTS TO RELIGIOUS CHARACTER OF SCHOOLS (DESIGNATION PROCEDURE) REGULATIONS 1998

62.  Regulation 9 of the Religious Character of Schools (Designation Procedure) Regulations 1998(1) shall be amended in relation to Wales as follows—

(1) in paragraph (2) for “appropriate diocesan authority” there shall be substituted “the diocesan authority which is intended to be the appropriate diocesan authority when the school opens”;

(2) in paragraph (6)(a), for “foundation governor” there shall be substituted “temporary foundation governor (within the meaning of Part III of the Education (New Schools) (Wales) Regulations 1999 or the 1996 Act, as the case may be)”.

(3) there shall be inserted at the end the following paragraph—

“(7) In paragraph (1) the reference to proposals to establish a new school being approved under paragraph 3 or 8 of Schedule 6 to the 1998 Act shall include, in a case where proposals were published before 1st September 1999, proposals approved under section 43 of the Education Act 1996 as that section continues to apply by virtue of regulation 8 of the Education (Transition to New Framework) (School Organisation Proposals) Regulations 1999.”.
