If, in respect of a ship, there is a breach of any of the requirements of these Regulations the master and the owner shall each be guilty of an offence punishable on summary conviction by a fine not exceeding the statutory maximum or, on conviction on indictment, by imprisonment for a term not exceeding two years, or a fine, or both.

Any person who fails to carry out any duty assigned to him under regulation 5(5), (6) or (7) shall be guilty of an offence punishable on summary conviction by a fine not exceeding the statutory maximum.

In any proceedings for an offence under these Regulations it shall be a good defence for the person charged to prove that he took all reasonable steps to avoid the commission of the offence.
