The Civil Courts (Amendment) (No. 3) Order 1999

Coming into force in accordance with article 1

The Lord Chancellor, in exercise of the powers conferred upon him by section 99(1) of the Supreme Court Act 1981(1), sections 2(1) and 26 of the County Courts Act 1984(2) and section 374(1) of the Insolvency Act 1986(3), hereby makes the following Order:—

Citation, commencement and interpretation

1.—(1) This Order may be cited as the Civil Courts (Amendment) (No. 3) Order 1999 and shall come into force:

(a)as to articles 3 and 4(3), on 31st January 2000; and

(b)as to the remainder of this Order, on 20th December 1999.

(2) In this Order, a Schedule referred to by number alone means the Schedule so numbered in the Civil Courts Order 1983(4).

Amendments to the Civil Courts Order 1983

2.  In Schedules 1 and 3 the entry relating to Bridgwater shall be deleted(5).

3.—(1) In Schedule 1:

(a)in the entry relating to Romford, “Grays Thurrock” shall be deleted from the second column;

(b)the entry relating to Great Yarmouth shall be deleted.

(2) In Schedule 3:

(a)the entries relating to Grays Thurrock and Great Yarmouth shall be deleted;

(b)in column 4 of the entry relating to Lowestoft, for “Great Yarmouth” there shall be substituted “Norwich”.

Transitional provisions in relation to Admiralty proceedings

4.—(1) Article 5 of the Civil Courts (Amendment) (No. 2) Order 1999(6) shall continue to have effect, subject to the following paragraphs of this article.

(2) Bristol County Court shall have jurisdiction in respect of Admiralty proceedings which were commenced in or transferred to Bridgwater County Court before 26th April 1999, and are in existence in Bridgwater County Court immediately before this paragraph comes into force.

(3) Lowestoft County Court shall have jurisdiction in respect of Admiralty proceedings which were commenced in or transferred to Great Yarmouth County Court before 26th April 1999, and are in existence in Great Yarmouth County Court immediately before this paragraph comes into force.

Explanatory Note

(This note is not part of the Order)

This Order amends the Civil Courts Order 1983 so as to:—

(a)close the district registry and county court at Bridgwater, with effect from 20th December 1999; and

(b)close the district registry and county court at Great Yarmouth, and the county court at Grays Thurrock, with effect from 31st January 2000.

Directions given on behalf of the Lord Chancellor under section 2(3) of the County Courts Act 1984 will determine which court districts will include the former district of Bridgwater with effect from 20th December 1999, and those of Grays Thurrock and Great Yarmouth with effect from 31st January 2000.
